TERMS OF USE

These Conditions of Use regulate the access and use of the platform, including the content and services made available to Users in and / or through the Community, either by FECD, by its Users or by third parties. 

Likewise, within the platform there is the possibility for the user to access the area to create or support projects, it will be subject to particular conditions.

1. PURPOSE OF THE SERVICE

FECD offers a service in which registered users can access an open platform, fecd.aroyi.org, to propose or support social development projects, and share those projects with other users of the platform.

All crowdfunding campaigns published on fecd.aroyi.org that achieve a collection equal to or greater than their defined minimum budget, may be subject to a rate of 4% of the total amount of money raised in the campaign plus taxes, plus the finance charges for use of the Stripe credit card payment system; These values ​​of commissions and financial costs will be deducted from the total collected by the platform, at the time of successful completion of the campaigns, that is, when the campaigns reach the minimum financing budget defined in the project or manage to exceed it.

The 4% commission is applicable to all the money raised by projects that manage to reach or exceed their minimum budget defined during their campaigns, including that corresponding to venture capital, where appropriate, as in the case of matchfunding calls.

In cases where crowdfunding campaigns do not reach the minimum financing budget defined in the project, the service will not be subject to any cost from the platform.

2. CONDITIONS 

The use of fecd.aroyi.org will be subject to the following Conditions, which may be updated periodically, however, FECD will notify the modification of the General Conditions or the Privacy Policy. If the User decides not to accept the Conditions, they must refrain from accessing and / or using the content and / or services offered on the platform.

FECD reserves the right to improve, modify or eliminate, unilaterally and without prior notice, the services and / or contents of said Community, according to the most diverse criteria. 

Obligation to use the portal correctly:

The User agrees to make proper use of the platform and not to use it to carry out illegal activities or activities contrary to good faith and legal regulations (merely indicative and not exhaustive); Causing damage to the physical and logical systems of the person in charge, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage, without forgetting all those that violate or violate honor, personal or family privacy and the image of people, property rights and any other nature belonging to a third party as a result of the transmission, dissemination, storage, availability, reception, obtaining or access to the content or image of third parties; the performance of acts of unfair competition and illegal advertising as a result of the transmission, dissemination, storage, making available, reception, obtaining or access to the content; the lack of veracity, accuracy, completeness, relevance and / or timeliness of the contents, leaving the User, in any case, harmless before the FECD against any claim, judicial or extrajudicial.

The User is solely responsible for the contents and files made available on the portal, for this reason, he undertakes not to publish (or upload) any file (understand video, audio, text, etc.) that is subject to intellectual property rights (or industrial) of third parties, unless the legal owner of said rights has granted a license or formal authorization in accordance with the license that governs this portal. 

FECD excludes any liability for damages of any kind that may be due to the content provided or supplied by any third party.

Use and custody of the username and password:

The User undertakes to make diligent use of the password and the User Name and to keep both secrets. It will be the sole responsibility of the User to maintain the confidentiality of her password, thus assuming all damages, expenses and / or damages of any kind derived from the breach of this obligation or the disclosure of the password, as well as the misuse that

Cancellation of access, services and contents:

FECD may, at its sole discretion, deny, withdraw, suspend and / or block at any time and without prior notice access to the content or the platform itself to those Users who violate these Conditions, being able to delete their account and all information and files related to it or, where appropriate, deny access to said files or to the platform itself. FECD will not assume any responsibility for the cancellation of access to it. FECD reserves the right to limit, totally or partially, access to certain Users, as well as to cancel, suspend, block or eliminate certain types of content through the use of appropriate technological instruments for this purpose, if it had effective knowledge that the activity or information stored and / or disseminated is illegal or damages the property or rights of a third party.

Likewise, the User who deems it appropriate has the possibility of informing FECD of those contents / users that may be in breach of said conditions. In the event that FECD verifies the veracity of said complaints, it may, as established in the preceding paragraphs, delete / cancel the reported content / users.

Communications and notifications:

All communications and notifications made will be considered effective for all purposes when they are made via email to the email address that the User has provided. The User expressly acknowledges that said data has been provided by himself and is completely true. Communications and the management of personal data are regulated in accordance with the Privacy Policy. 

Unsubscribe from the platform:

In the event that the User wants to unsubscribe from the platform, they can do so from the box enabled for this purpose. The withdrawal as a user and the treatment of your data will be carried out in accordance with the provisions of the Privacy Policy.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY

The contents, as well as the information object of intellectual property whose ownership corresponds to FECD or the registered Users made available on the platform (unless expressly specified otherwise), may be reproduced, publicly communicated, transformed or extracted freely in a way non-exclusive, total or partial, by any person, in any format, without any temporal or territorial restriction and, for any subsequent legitimate use, under the following conditions: It must always be indicated, and, in any case, the authorship and it must be shared equally in accordance with the Creative Commons 3.0 By - SA license that governs this platform. 

Likewise, as it is a platform dedicated to the commons, the characteristic of the projects that are proposed and supported through it is the choice of open licenses, leaving them to the decision of the user who proposes the project from a list of Proposals from those responsible for fecd.aroyi.org. 

As for the industrial property rights that may correspond to said content, as well as all trademarks, trade names or any other distinctive sign, they are owned by the FECD or their legitimate owners, all rights over them being reserved. 

Oigo will not be responsible for any damages that may arise from the use of the contents, services, and information included in this website by users, or from the violation by them of any current legal provision.

4. MINORS

Full responsibility in determining the specific content and services accessed by minors corresponds to the adults in whose charge they are. Unauthorized minors are prohibited from accessing and using the Portal. FECD understands that from the moment a minor accesses the Portal, they have the permission of their parents, guardian, or legal representative.

Since the Internet allows access to content that may not be suitable for minors, Users are informed that there are mechanisms, in particular for filtering and blocking computer programs, that allow limiting the available content and, although they are not infallible, they are especially useful for controlling and restricting the materials that minors can access.
